The Economic and Financial Crimes Commission, on Tuesday, following the earlier re-arrest of Justice Rita Ofili-Ajumogobia at the Ikeja High Court have stated the reason behind her arrest after she was discharged of criminal charges by the Lagos High Court.

The Commission, in its statement, said her re-arrest is in line with the decision of the Court of Appeal, Lagos Division, in a case involving Justice Hyeladzira Nganjiwa where it said that the judge can only be prosecuted until she is dismissed or compulsorily retired by the National Judicial Council.

The commission added that Justice Ofili’s case is presently before the NJC for disciplinary action, noting that the Judiciary body has taken action but the commission will forge ahead and approach the court to prefer fresh charges against her.

The EFCC statement said: “In view of today’s ruling by Justice Oshodi and having complied with the NJC procedure, the Commission is set to prefer fresh criminal charges against the first defendant, Ofili-Ajumogobia.”

The embattled female justice is facing 30-count charges bordering on prevision of the course of justice, graft, unlawful enrichment, providing false information and forgery.

Justice Ajumogobia has since last year November pleaded not guilty to the charges preferred against her, thereby setting the stage for the trial.
