After the High Court in Kaduna State granted El-Zakzaky and his wife, who had been held in detention since 2015 by the government, permission to travel to India for medical treatment, the Kaduna State Government appealed to Indian authorities not to grant asylum status to the leader of the Islamic Movement in Nigeria.

The state government declared in a statement signed by the Commissioner for Internal Security and Home Affairs, Samuel Aruwan, that the Islamic cleric would be prevented from facing justice for his alleged offences if he is granted asylum in India.

The federal government has accused the cleric and followers of disturbing public peace and posing a threat to national security, and according to Samuel, India and other countries must not accommodate El-Zakzaky, as he must return to face trials for his actions.

Aruwan said in his statement, "Malam Ibrahim El-Zakzaky is facing criminal trial before the Kaduna High Court on charges filed in April 2018. The Kaduna State Government is prosecuting Malam (El-Zakzaky) on an eight-count charge, including culpable homicide punishable with death.

“The Kaduna State Government respects the right of anyone to seek treatment anywhere in the world.  But in the case of persons facing trial for serious offenses, necessary safeguards are required to ensure that such persons do not become fugitives from justice or frustrate trial by claiming asylum or the status of political prisoner in the host country."
