Femi Falana Files Motion Against Sowore’s Detention Order

Human rights activist and Senior Advocate of Nigeria, SAN, Mr. Femi Falana, has been briefed by RevolutionNow leader, Omoyele Sowore, to be his legal representative in court.

Femi Falana has now filed a motion to challenge the legality of the order of the Federal High Court in Abuja which gave the Department of State Services, (DSS), full permission to detain the convener of the RevolutionNow protest, Omoyele Sowore, for 45 days.

Justice Taiwo Taiwo, who oversaw proceedings in the case, had informed the DSS that they are at liberty to return for an extension of the detention order after September 21, 2019. Falana, however, has contended the order, saying the Judge had granted an illegal and unconstitutional ex parte application which was brought by the DSS.

The senior lawyer, Falana, who has successfully helped Islamic Movement in Nigeria (IMN) leader, Ibrahim El-Zakzaky, secure a court order for medical treatment abroad has now dug his roots in Sowore's case and claims that the detention order breached the fundamental right provisions of the 1999 Nigerian Constitution (amended).

In a lawsuit filed, case No: FHC/ABJ/CS/879/2019 between State Security Service V. Omoyele Sowore, Falana has now applied for:

“An order of this honourable court setting aside, discharging and/or vacating the ex parte order of this honourable court for the detention of the Respondent/Applicant for a period of 45 days made on the 8th August, 2019."
